Comelec exec: No violation in publication of survey results 15 days before May 9

MANILA, Philippines — There is no such thing as a violation in publishing election survey outcomes, involving nationwide candidates, 15 days earlier than Election Day.

This was in keeping with Fee on Elections (Comelec) spokesperson James Jimenez on Tuesday, as Pulse Asia launched the outcomes of its voter desire surveys for president, vice chairman, and senators on Could 2, seven days earlier than the polls on Could 9.

Jimenez was requested on the social media web site Twitter if the discharge of survey outcomes was in violation of Republic Act (RA) No. 9006 or the Truthful Elections Act.

“No. The availability being cited – Sec. 5.4 of RA 9006 – was struck down by the Supreme Courtroom for being unconstitutional,” the spokesman responded.

Part 5.4 of RA No. 9006 states: “Surveys affecting nationwide candidates shall not be revealed fifteen (15) days earlier than election and surveys affecting native candidates shall not be revealed seven (7) days earlier than an election.”

However Jimenez cited GR No. 147571, declaring the mentioned part unconstitutional.
